Pros of Collaborative Divorce

You and your spouse sit down together to work through every detail. That means you retain control over the outcome of the division of debts and assets as well as the parenting plan, spousal support, and any child support. This helps you and your spouse stay in control of the process. Unlike court proceedings which are a matter of public record, collaborative divorce is a private process. You are also never interrogated by the other person’s attorney. Perhaps the biggest reason to consider collaborative divorce is that it is the most cost-effective means to divorce. There is no mediator to pay and your attorney draws up the papers and provides guidance.

Cons of Collaborative Divorce

The downside of not having someone like a mediator to help you through the process is that you may not be able to come to an agreement on all issues. Afterall, when most people divorce there are at least some acrimonious feelings. Because the process is based on trust, if you cannot fully trust your spouse to disclose all their assets, you may not end up with a fair settlement. Another downfall of this process is if you cannot come to an agreement, you have wasted time. You also will have to find a new attorney if you abandon this process and head to litigation.
