Pros and Cons of Divorce Through Mediation

Divorce mediation is both a relatively new concept and one that people have been using for quite some time. People have been going back and forth, giving and taking, to get what they want in their divorce for ages, but only recently has it become something that is both a recommended and formalized process. For many couples, it is a good means to dissolving their marriage. However, there are pros and cons you should be aware of before choosing it for your dissolution.

Reasons You May Want Divorce Mediation

There are many reasons mediation is a good solution. However, we think these are the three best reasons:

  1. You have more control over the outcome than when you go in front of the courts.
  2. The process is private so only your attorneys, the mediator, and the two of you know what went on in your sessions. The details of your settlement also remain private.
  3. Divorce mediation is significantly faster (in most cases) than going in front of a judge. A faster divorce is also a less costly divorce.

When you cannot divide your assets, establish a parenting schedule you both agree upon, and/or spousal support, having a mediator who can suggest solutions that you may not have considered helps you over the hurdle. They can also help you move on to another topic if you come to an impasse and remind you to circle back to open issues.  

Cons of Divorce Through Mediation

If you cannot stand to be in the same room as your soon to be ex-spouse, divorce mediation will not work for you. It is not a viable solution for those who are in a domestic violence or abuse situation and rarely works when one party has narcissistic tendencies.
